Binding Agreement

Upon issuance of a booking confirmation from Kawaue Residence (KR), a legally binding agreement is formed between you and KR subject to these Terms and Conditions. If you book on behalf of additional guests, you are required to ensure that every additional guest is made aware of and agrees to these Terms and Conditions, and you are liable for the actions of such guests. Each guest on your booking must provide a copy of his/her passport and upon check-in becomes also a party to this agreement. For purposes hereof, “Guest” means you and such guests, joint and severally.  

Booking confirmation and Payment 

Booking is confirmed upon KR’s receipt of payment for the Total Amount as invoiced, which must be received prior to or on the Due Date specified on the Invoice. If such payment is not timely received by KR, the booking will be null and void. Prior to check-in, Guest must make a Security Deposit as specified on the Invoice, and provide a valid credit card for the duration of the reservation as a guarantee for any extra-charges, missing property or damages not covered by the Security Deposit.  

Arrival and departure

As specified on the Invoice.

Guest must vacate at the check-out time and date.  

What is included in the fee?

Accommodation, water services and power, futon linen and towels, use of kitchen appliances and washing machine, WIFI use where available. A starter kit of soaps, dish detergent, laundry soap, shampoo, toilet paper, and paper towels will be provided, but Guest should plan to shop to replenish these items if necessary. 

What is NOT included in the fee?

Food, beverages, activities, transfer services.

Cancellation policy

Upon booking and up to 12 weeks (85 days) prior to check-in date: 25% cancellation fee (75% refund)

From 12 weeks(84 days) prior to check-in date up to 6 weeks(43 days) prior to check-in date: 50% cancellation fee (50% refund)

From 6 weeks(42 days) prior to check-in date / no show: 100% cancellation fee (no refund)

KR may at any time cancel the booking giving a full refund for the cancelled period.

Shortened stays 

After check-in, there shall be no refunds due to shortened stays for any reason.

Number of Guests

The number of Guests accommodated in the house may not exceed the number on the Invoice, without KR’s prior written consent. Day/evening guests are limited to 2 persons. Transferring the reservation to a substitute guest or subletting, is not permitted without KR’s prior written consent. KR reserves the right to refuse admittance or terminate a booking or this agreement if these conditions are not observed. 

Equipment and Internet

Equipment may occasionally malfunction and is not guaranteed to be operational 100% of the time. High speed wireless internet is provided as a convenience only and is not part of our service. Refunds will not be issued due to malfunctioning equipment or unavailability of internet connection. 

Smoking and fire hazards

The house is made of wood and paper so it is highly vulnerable to fire. Smoking and any fire hazards in the house or its outbuildings is strictly prohibited. KR reserves the right to terminate the booking and charge a JPY 50,000 surcharge, if this condition is breached.

Noise 

Guest must not create noise or disturbances likely to disturb or annoy the surrounding property owners after 10:00 PM. 

Waste

Guest shall dispose and separate waste following KR’s instructions. 

Pets/Animals

Not permitted.

Drugs, firearms, weapons

Not permitted.

Right to enter property

KR reserves the right to enter the house/rooms and turn off air-conditioning/heating when it is obvious that the occupant has departed the premises and these appliances are still operational.

Lost, stolen or abandoned items

KR bears no responsibility for lost, stolen or abandoned items. We will make all reasonable efforts to contact you for returns. A JPY 5,000 handling charge plus shipping costs apply for any found items returned at Guest’s request. We will not be liable for the condition of such items and items not claimed for more than 30 days may be thrown away, donated or sold. 

Use of the premises, damage or breakages 

Guest must take all reasonable care of the premises and its contents and use these only in a careful and lawful manner to ensure that at the end of their stay the premises and its content are good, clean and tidy (in the condition in which they were at check-in). Failure to return the premises or its contents clean and tidy may result in a cleaning charge of JPY 20,000 payable on departure.

Guests must notify KR of any damages/breakages to the premises or its contents during their stay. Any damages (including what KR may consider excessive wear and tear), breakages or missing items during the accommodation will be Guest’s responsibility and must be paid prior to departure or (at KR’s sole discretion)deducted from the security deposit. If discovered after departure, Guest will be charged for the rectification/replacement or maintenance cost plus a 50% surcharge. This will be charged to your credit card.

Personal belongings and injury

The use of the house, car park and amenities is entirely at the Guest's risk and no responsibility will be accepted for personal injury, or for loss or damage to the Guest’s belongings or vehicles.

The Guest must purchase its own insurance for loss or damage to its personal property, vehicles and for personal injury, if such coverage is desired. 

KR’s liability

Guest shall indemnify and hold harmless KR against any and all claims of personal injury or property damage, liability or loss (including reasonable attorney fees and costs) incurred or suffered by Guest arising from use of the premises or during any activities organized by KR, regardless of the nature of the accident, injury or loss (including negligence). Guest expressly recognizes that any insurance for property damage or loss which KR may maintain on the premises does not cover Guest’s personal property or injury to Guests.

Termination

Should the Guest violate any of the terms of this agreement, KR may terminate this agreement immediately. The Guest hereby waives all rights to process if it fails to vacate the premises on the departure date, and agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by KR enforcing this agreement.

Governing Law

This agreement is governed by the laws of Japan without regard to conflict-of-law provisions. 

Jurisdiction

Each party to this agreement hereby agrees that any action, proceeding or claim arising out of, or relating in any way to this agreement shall be brought and enforced exclusively in the courts of Japan. Each party hereby waives any objection to such exclusive jurisdiction and waives any argument that such courts represent an inconvenient forum.
